ACLU’s Reign of Terror Comes to an End in Santa Rosa County, FLA School District

Santa Rosa County, FL – The ACLU reign of terror has come to an end in the Santa Rosa County School District in the panhandle of Florida. After intense litigation brought by Liberty Counsel, and on the eve of trial later this month, the ACLU and the District agreed to modify a prior Consent Decree.

There are a dozen constitutional freedoms that Liberty Counsel won back for teachers, staff, students, and members of the community as a result of this settlement. Students will be allowed to voluntarily pray, submit religious answers in homework, and freely participate in private, after-school, religious programs. Teachers will now be able to pray at school during their break times, pray during school events in a nonofficial capacity, attend and fully participate in baccalaureate services, have a Bible on their desk, wear religious jewelry, assign readings from the Bible to students when relevant to nonreligious academic assignments, and more. “God bless” is no longer forbidden.

The ACLU filed suit against the District and obtained a Consent Decree. The District rejected Liberty Counsel’s offer to represent it pro bono against the ACLU. Liberty Counsel then filed a motion to intervene to become a party-defendant to provide an adequate defense, but the ACLU and the District opposed Liberty Counsel. Liberty Counsel then had no choice but to file a direct suit against the District to regain the constitutional rights taken away by the Consent Decree. Facing trial with damning evidence uncovered by Liberty Counsel, the District and the ACLU agreed to back away from the Consent Decree.

For three years the ACLU terrorized people with threats of contempt charges. Liberty Counsel had to defend Principal Frank Lay and Athletic Director Robert Freedman against criminal contempt charges, the penalty of which could have been a $5,000 fine, six months in jail, and loss of their collective 70 years of retirement benefits. The alleged “crime” was a short blessing over a meal. Liberty Counsel also had to defend Michelle Winkler, a staff worker, against civil contempt charges (up to $30,000 in fines) after her husband said a prayer in a neighboring county at a private event to honor noninstructional staff.

Freedom is Restored to Santa Rosa County School District on Eve of Independence Day

Consider the LiliesPensacola, FL – After months of litigation against the ACLU and the Santa Rosa County School District, and on the eve of Independence Day, Liberty Counsel has restored freedom to the Santa Rosa County, Florida, School District teachers, staff, students, and members of the community. Faced with an imminent trial and damning evidence of their constitutional violations, the ACLU and the Santa Rosa School District have agreed to settle Liberty Counsel’s federal lawsuit, challenging their Consent Decree on behalf of 24 students, teachers, parents and community members. The Consent Decree that led to criminal indictments against school employees for prayer and banned “God Bless” in Santa Rosa County schools will now be gutted and revised. The amended Consent Decree will restore dozens of constitutional religious freedoms that were previously denied. In addition, Liberty Counsel and Christian Educators Association International will be awarded $265,000 in attorney’s fees and costs from an insurance provider, not the taxpayers, to compensate them for the litigation caused by the ACLU and the District.

This is a huge step in the right direction and a victory for the citizens in Santa Rosa County. This settlement ends a two-year court battle against a Consent Decree that threatened the religious freedoms of Americans everywhere and made headlines across the nation for its anti-Christian attacks, such as charging school leaders with crimes or contempt for saying a prayer over their meal.

The notice of settlement was filed with the court this morning and awaits official approval by the school board and the court. As a result of this settlement, Liberty Counsel’s clients who are teachers will now be able to pray at school during their break times, pray during school events in a nonofficial capacity, attend and fully participate in baccalaureate services, have a Bible on their desk, wear religious jewelry, and assign readings from the Bible to students when relevant to nonreligious academic assignments. Students will be allowed to voluntarily pray, submit religious answers in homework, and freely participate in private, after-school religious programs.
